Alpha Forsyth vs. John M. Layson et al. Adams Circ. Court of Oct. Term 1852 And now come the said complaintants Eliza Mustain & Daniel C. Mustain, her husband, Susan W[ood] Zachariah Wood her husband, Mary J. Owen and Archibald Owen, her husband, and ? that the bill herein as to them be dismissed, which motion being hear[d] is sustained?, and the court doth order and decree that said bill be and the same hereby is dismissed as to said Eliza Mustain, Daniel C. Mustain, Susan Wood and Zachariah Wood, Mary J. Owen & Archibald Owen the same having been in?dently made complainants, and at the same time for comes the said Alpha Forsyth and int? his cross cross motion for leave to ammend his bill herein and make the said Eliza Mustain & Daniel C. Mustain, Susan Wood & Zachariah Wood, Mary J. Owen & Archibald Owen defendants in the proceeding, which motion is allowed, and it is hereby ordered, that said complainant have leave to amend his bill generally and to make defendants in this proceeding the said complaintants as to whom said bill has been dismissed without taking out p?cess against said now defendants and that the case stand continued.
